Did The Accident Cause Injury To You?
We need to establish that the accident definitely caused your injury. In most cases this will be obvious, but in certain circumstances, careful investigation may be required to prove the point.
Did The Accident Or Injury Happen Within The Last Three Years?
By law, a claim must usually be made within 3 years from the date of an accident, or diagnosis in the case of an industrial disease. This varies if the accident involved sea or air travel (two years) and injury to children (the three year period does not begin until the child's 18th birthday). However, in the case of occupational diseases, even if the diagnosis was made many years ago, you may still be able to pursue a claim.
Was Another Person To Blame?
The key issue is whether or not your accident/injury would have happened without the actions of someone else. For example, you would have a claim if someone else ran into the back of your vehicle, or if you contracted an industrial disease due to lack of suitable protective equipment.
